This paper focuses on the plight of people living with a disability detained in Australian run immigration detention centres, in both onshore and offshore facilities (including Christmas Island, Nauru and Manus Island). It does not examine the suitability of community based options such as Community Detention and release into community on a bridging visa for people living with disabilities.

In 2008, the Council of Australian Governments created a new 5 year National Disability Agreement (NDA), which would provide continued funding for services to people with disability in Australia. The new agreement was framed amidst an Australian Government reform agenda, which in replacing the old Commonwealth States and Territories Disability Agreement, would bring a new direction to disability service provision, including a focus on working within the rights laid out in the United Nations Convention on the Rights of Persons with Disabilities.
